Hunting Lease Agreement
This Hunting Lease Agreement (the "Agreement") is entered into effective as of __________ (the "Effective Date"), by and between __________, with a mailing address of __________ (the "Landowner"), and __________, with a mailing address of __________ (the "Lessee"). Landowner and Lessee are collectively referred to herein as the "Parties."
WHEREAS, the Landowner is the owner of certain real property known as __________, located in __________, __________ (the "Property"); and
WHEREAS, the Lessee desires to lease the Property for the purpose of hunting (the "Activity"), and the Landowner wishes to lease the Property to the Lessee for such purpose, subject to the terms and conditions set forth below.
1. Lease
The Landowner hereby leases to the Lessee, and the Lessee hereby leases from the Landowner, the Property for the term commencing on __________ and ending on __________ (the "Lease Term"), strictly for the purpose of conducting the Activity, subject to the terms and conditions of this Agreement.
2. Lease Payment
The Lessee agrees to pay the Landowner a total lease payment of __________ Dollars ($__________) (the "Lease Payment"), payable as follows: __________.
3. Use of Property
The Lessee shall use the Property solely for the purpose of the Activity and shall comply with all state and federal laws, including but not limited to __________ State Hunting Regulations, and any local ordinances and regulations relating to hunting and wildlife conservation.
4. Maintenance and Improvements
The Lessee shall maintain the Property in good condition, ordinary wear and tear excepted, and shall not make any alterations or improvements without the prior written consent of the Landowner. Upon termination of this Agreement, the Lessee shall, at the Lessee's expense, remove any such alterations, improvements, or structures placed on the Property by the Lessee, unless otherwise agreed in writing by the Landowner.
5. Indemnification
The Lessee agrees to indemnify, defend, and hold harmless the Landowner and its agents, employees, and representatives from any and all claims, lawsuits, damages, losses, liabilities, and expenses, including reasonable attorneys' fees, arising out of or resulting from the Lessee's use of the Property, except where such claims arise from the negligence or willful misconduct of the Landowner.
6. Insurance
The Lessee agrees to carry, at the Lessee's own expense, comprehensive general liability insurance with limits no less than __________ Dollars ($__________) per occurrence, naming the Landowner as an additional insured. Proof of insurance shall be provided to the Landowner before the commencement of the Lease Term.
7. Termination
This Agreement may be terminated by either Party upon __________ days' written notice to the other Party.
8. General Provisions
- Entire Agreement: This Agreement constitutes the entire agreement between the Parties and supersedes any prior understandings or agreements regarding the subject matter hereof.
- Governing Law: This Agreement shall be governed by and construed in accordance with the laws of the state of __________, without giving effect to any choice or conflict of law provision or rule.
- Amendments: No amendment to this Agreement shall be effective unless it is in writing and signed by both Parties.
- Notices: Any notices required or permitted under this Agreement shall be in writing and shall be deemed to have been duly given when received if personally delivered; when transmitted if transmitted by facsimile or email; or on the third day after mailing if mailed by first class mail.
