Entering into a Horse Training Contract is a significant step for both the horse owner and the trainer, establishing a formal relationship and setting the terms under which training will be conducted. This comprehensive document, created by NSA Horsemanship LLC, encapsulates the various aspects and responsibilities each party agrees to, from the commencement of the training period to its conclusion. It outlines the fees, term, location, and payment schedules, ensuring transparency in financial dealings. Importantly, it also sets expectations regarding the horse's care, including feed, medical treatments by a veterinarian or farrier, and conditions of the facilities. The contract addresses potential risks and liabilities, incorporating clauses on the horse's death, risk of loss, and standards of care to protect both parties. Assumption of risk and a Hold Harmless Agreement are included to acknowledge the inherent dangers of horse training and boarding. Amendments, lien rights, emergency care provisions, ownership verification through a Coggins test, and rules for termination or changes to the agreement form part of this detailed contract, designed to preemptively address any concerns and clarify the responsibilities of the horse owner and trainer. This agreement underscores the commitment to the horse's wellbeing and training progress, while also protecting the interests of both the owner and trainer through its detailed clauses.

Trainer shall assume that Owner desires surgical care if recommended by a veterinarian in the event of colic, or other life-threatening illness, unless Trainer is instructed herein by Owner or on Owner's Information Sheets, that the horse(s) is/are not surgical candidates.

Owner agrees to notify Trainer of any and all change of addresses, emergency telephone numbers, itineraries or other information reasonably necessary to contact Owner in the event of an emergency. In the event Owner departs for vacation or is otherwise unavailable, prior to departure Owner shall notify Trainer as to what party is authorized to make decisions in the Owner's place with regard to the health, well-being, and/or medical treatment of the horse(s).

Owner is also required to provide thirty (30) days notice that they wish to discontinue said services and remove the horse from traing.

However, Trainer will not be obligated to retain and/or maintain the horse(s) in question in the event the amount of the bill exceeds the

anticipated unregistered value of the horse(s.) In the event Trainer exercises Trainer's lien rights as above-described for non-payment, this Agreement shall constitute a Bill of Sale and authorization to process transfer applications from any breed registration as may be applicable to said horse(s) upon affidavit by Trainer's representatives setting forth the material facts of the default and foreclosure as well as Trainer's compliance with foreclosure procedures as required by law. In the event collection of this account is turned over to an attorney, Owner agrees to pay all attorney's fees, costs, and other related expenses for which a minimum charge of $250.00 will be assessed.

How to Fill Out Horse Training Contract

To ensure a transparent and efficient agreement between a horse owner and a trainer, it's crucial to meticulously complete the Horse Training Contract form. This document outlines the commitments of both parties and sets clear expectations for the training period, fees, and treatment of the horse. In order to fill out this form accurately, attention to detail and a thorough understanding of each section are essential. Below, you’ll find a step-by-step guide to assist you through this process.

  1. Start by filling in the date of the agreement at the top of the contract where it states, "WITNESS THIS AGREEMENT this _____ day of _______, 20__." Insert the current day, month, and year.
  2. In the section labeled "Trainer" and "Owner," write the full name of the horse owner or, if the owner is a minor, the name of the parent or guardian.
  3. Identify the horse being placed into training by writing its name in the space provided after "Trainer agrees to accept Owner's horse _________________, for training."
  4. Detail the specific goals or events for which the horse is being trained in the space provided. Be as precise as possible to ensure mutual understanding of the expected outcomes.
  5. Under "Fees, Term, and Location," enter the agreed monthly fee plus any applicable taxes, or the daily rate if relevant, and the minimum duration of training in months. If the training period doesn't start on the first day of the month, ensure the pro-rating arrangement is clearly noted.
  6. In the "Payment of Services" section, acknowledge the due date for monthly training fees and the late payment penalties.
  7. For "Veterinarian, Farrier, and Related Services," specify if the owner prefers to use their veterinarian and farrier. Otherwise, confirm understanding that the trainer will choose these services.
  8. Sign and date the bottom of the first page to indicate agreement with the terms so far.
  9. Review and agree to the training methods under "Training of Horse." If the trainer suggests individual lessons, note the agreed hourly rate for these sessions.

  13. Read and agree to the inherent risks and assumption of risk, particularly concerning equine activities, as provided in the contract.
  14. Indicate whether the horse will be insured for a value exceeding $5,000, and, if so, provide the insurance company’s details as required.
  15. For "Emergency Care," ensure all contact information is up to date and specify any surgical care directives for the horse(s).
  16. Confirm the horse's ownership and agree to provide a negative Coggins test upon the trainer’s request.
  17. Consent to the terms around "Changes or Termination of This Agreement," recognizing the conditions under which either party may alter or end the contract.

Frequently Asked Questions

What are the payment terms for horse training services?

Payment for horse training services is structured around a monthly fee due on the 1st of each month for the duration of the horse's training. The contract specifies the cost per month, plus any applicable taxes, for both training and boarding services. An initial payment is prorated from the horse's arrival date to the start of the next month, and this payment, along with a signed contract, is required before the horse's training begins. If a payment is overdue by five days, training will cease, and a late fee of $10.00 per day will be applied until the balance is paid in full. The trainer also has a lien right against the horse and/or equipment for any outstanding amounts, which could lead to the sale of the horse and/or equipment to cover debts under New Mexico law.

Can the owner specify a veterinarian or farrier for their horse?

Yes, the owner has the option to request specific veterinarians and farriers to be used for their horse's care. If the requested professionals are unavailable, the trainer reserves the right to engage a veterinarian and farrier of their choosing to ensure the horse receives necessary care. All expenses for such care, including routine and emergency services, will be the responsibility of the owner, and payment for these services is expected within fifteen days of billing.

What is the policy regarding the death of a horse during training?

In the unfortunate event of a horse's death, sale, or if the horse becomes unfit for training, the trainer is given the option to either accept a different horse for training under the same terms or terminate the contract. If the latter option is chosen, all outstanding expenses and fees up to that point must be paid by the owner. This policy ensures that both parties have a clear understanding of the steps to be taken under such circumstances, aiming to handle these situations with fairness and sensitivity.

What are the owner's rights and responsibilities regarding visiting and checking on their horse?

Owners are encouraged to regularly visit the training facility to check on their horse's progress. Visits can be made at any time, and the trainer will make every effort to accommodate the owner. Nonetheless, if a visit coincides with a training session or if the horse has already completed its training for the day, an additional session will not be provided without a prior appointment. Setting up appointments helps ensure that both the owner's and horse's needs are met without disrupting the training schedule. This policy highlights the trainer's commitment to open communication and cooperation with horse owners.

Common mistakes

One common mistake people make when filling out a Horse Training Contract form is not clearly specifying the goals or events for which the horse is being trained. Omitting specific objectives can lead to misunderstandings about the desired outcomes of the training.

Another error is failing to detail the payment arrangement accurately, including the monthly fee, applicable taxes, and pro-rating terms. This omission can cause disputes over financial obligations later.

Individuals often neglect to agree upon the use of their preferred veterinarian and farrier. By not specifically requesting these service providers, the owner implicitly allows the trainer to use their discretion, possibly leading to dissatisfaction with the care provided.

Not providing a fully completed Owner's Information Sheet for each horse at the time of delivery can also lead to issues. This document is crucial for ensuring the trainer has all necessary information about the horse, and its absence can impede proper care and training.

A significant mistake is not discussing and understanding the protocol for emergency care. In the absence of explicit instructions, the trainer will make decisions that they deem best, which might not align with the owner's preferences or financial readiness.

Failing to verify ownership and provide proof of a negative Coggins test upon request is another oversight. This step is essential for the health and safety of all horses and people involved in the training facility.

Undervaluing the importance of understanding and abiding by the rules, termination clauses, and amendments of the agreement can lead to complications. Being unaware of the conditions under which the contract can be changed or terminated puts owners at a disadvantage.

Owners sometimes forget to disclose the full scope of their horse's insurance coverage to the trainer. This omission can result in inadequate protections for both parties should an incident occur.

Last but not least, not reading and fully understanding every aspect of the contract before signing it is a prevalent mistake. This includes being unaware of the right of lien the trainer holds for unpaid services, which can lead to unexpected consequences for the horse owner.

Documents used along the form

When you're working with a Horse Training Contract, there are several other documents that frequently come into play to ensure everything goes smoothly. These forms and documents complement the training contract, covering a variety of aspects from veterinary care to liability issues. Understanding each one can help owners and trainers ensure all bases are covered.

  • Owner’s Information Sheet: This document collects all necessary details about the horse's owner, including contact information, which is crucial for any correspondence or emergency situations.
  • Equine Insurance Proof: Owners may need to provide proof of equine insurance, which covers the horse while it's in training. This insurance can protect against unforeseen circumstances such as illness, injury, or even death of the horse.
  • Veterinary Care Authorization Form: This form grants the trainer permission to seek veterinary care for the horse in case of an emergency when the owner cannot be reached, ensuring the horse receives timely medical attention when needed.
  • Release of Liability Waiver: Often required by trainers, this waiver protects them from being held liable for injuries or damages that could occur while the horse is in training, acknowledging the inherent risks involved with equine activities.
  • Boarding Agreement: If the horse is being boarded at the facility during its training, a boarding agreement outlines the terms and conditions of this arrangement, including feed, housing, and financial responsibilities.
  • Training Progress Reports: While not always formal documents, regular updates or reports on the horse's training progress help keep the owner informed and involved in the process.
  • Bill of Sale: In cases where a horse is sold during or after the training period, a bill of sale legally documents the transfer of ownership and outlines the terms of the sale.

Working together, these documents support the Horse Training Contract to create a comprehensive and clear agreement between the trainer and the horse owner. They help manage expectations, define responsibilities, and provide protections for both parties involved.

Similar forms

A Horse Boarding Agreement is similar to a Horse Training Contract as both agreements involve the care and management of horses by a third party. In a boarding agreement, the focus is on providing shelter, feed, and basic care for the horse rather than training. Both contracts outline the responsibilities and expectations between the horse owner and the service provider, including payment terms, liability, and the standard of care expected.

The Equine Lease Agreement shares similarities with the Horse Training Contract, mainly because both involve specific terms regarding the treatment and management of a horse. However, in a lease agreement, an individual gets the right to use the horse for a specified period, which could include personal riding or competing, unlike a training contract that is solely for the purpose of improving the horse's skills under professional guidance.

A Pet Sitting Contract is conceptually similar to the Horse Training Contract as it involves entrusting an animal to the care of a third party. Although pet sitting typically deals with domestic pets like dogs and cats and focuses on short-term care, both agreements cover aspects such as payment, care instructions, emergency procedures, and liability issues to ensure the animal’s welfare during the contracted period.

Service agreements, such as those for Dog Training, are akin to Horse Training Contracts in that both outline the terms under which training services will be provided to an animal. These contracts specify the methods of training, duration, fees, and expected outcomes. Both types of agreements also include clauses related to the animal's health and care requirements and detail the obligations of both the service provider and the client.

Livestock Care Agreements, similar to Horse Training Contracts, are used for the care and management of larger animals, often for purposes beyond training, such as breeding or grazing. These agreements cover many of the same considerations found in horse training contracts, such as feed, housing, medical care, and payment terms, acknowledging the responsibilities of the caretaker towards the animals entrusted to them.

An Animal Adoption Agreement, while primarily used in the context of adopting pets from shelters, shares some characteristics with Horse Training Contracts. Both documents are concerned with the welfare and future conditions of the animal in question, setting terms that aim to ensure the animal's well-being. However, an adoption agreement focuses on the transfer of ownership and the conditions related to that transfer, unlike a training contract's focus on service provision for a fee.

The Breeding Contract, often used in the context of horses, dogs, and other animals, looks at the specific terms under which animals are bred, including responsibilities related to care, payment, and the handling of offspring. While its main focus is different from that of a Horse Training Contract, both types of agreements are crucial in the management and care of valuable animals, ensuring clear terms and conditions to protect the interests of all parties involved.

Dos and Don'ts

When filling out the Horse Training Contract form, accuracy, clarity, and understanding of the terms are key. Here are some essential dos and don'ts to guide you through the process:

  • Do read the entire contract carefully before you start to fill it out. Understanding every clause will help you make informed decisions.
  • Do ensure that all the information you provide is accurate, especially your contact information and details about the horse.
  • Do clarify the training and services your horse will receive. Specify the goals, duration, and expectations clearly in the space provided.
  • Do discuss and understand the payment terms. Know when payments are due and what happens if a payment is late.
  • Do note any specific care instructions or medical needs your horse has and ensure they are clearly communicated in the contract.
  • Do sign and date the contract to indicate your agreement with the terms. A contract is not legally binding without your signature.
  • Do keep a copy of the signed contract for your records. It's important to have a personal copy for reference in case of disputes or discrepancies.
  • Don't leave any sections blank. If a section does not apply, write “N/A” (not applicable) to show that you didn't overlook the section.
  • Don't skim over the contract. Details such as termination clauses, late fees, and liability waivers are crucial.
  • Don't forget to specify any arrangements you've discussed with the trainer that aren't mentioned in the contract template.
  • Don't hesitate to ask for clarification on any part of the contract that you do not understand. It's better to ask questions now than to have misunderstandings later.
  • Don't ignore the sections about emergency care and insurance. Ensure you agree with the protocols in place for your horse’s well-being.
  • Don't agree to terms that you are uncomfortable with or do not agree with. Discuss adjustments with the trainer before signing.
  • Don't forget to review the contract for any typos or errors in the information you provide. Accuracy is key to avoid issues later.

Filling out the Horse Training Contract with attention to detail and a clear understanding of the terms will help create a positive and successful training experience for you and your horse.

Misconceptions

When entering into a Horse Training Contract, it's important to have a clear understanding of what the agreement entails. Unfortunately, there are several misconceptions that can lead to confusion and dissatisfaction. Here are five common misconceptions explained:

  • The Trainer Guarantees Results: A common misunderstanding is that signing a horse training contract guarantees specific training results. The truth is, a trainer cannot promise exact outcomes due to the unique nature of each horse's physical and mental abilities. The objective is to apply professional standards and efforts to achieve the best possible results.
  • Owner's Presence Is Not Necessary: While trainers undertake the primary responsibility for training, engagement from the owner is highly beneficial. The contract often suggests individual lessons for the owner to understand and reinforce the training methods, fostering better outcomes and a deeper bond between the owner and the horse.
  • Trainer Has Unlimited Decision-Making Power: Even though trainers make day-to-day decisions in the training and care of the horse, they do not have unlimited authority. For critical health decisions or those involving substantial expenses, the trainer typically needs to consult the owner, or in their absence, follow guidelines provided in the contract or by the emergency contact.
  • Training Fees Cover All Costs: Training contracts generally outline the trainer's fees, but it's a misconception that this covers all costs related to the horse's care. Additional costs for veterinary care, farrier services, and any other special needs are usually the owner's responsibility, highlighting the importance of thoroughly reviewing the agreement to understand all financial obligations.
  • Signing the Contract Limits the Owner's Rights: While the contract does spell out the responsibilities and limitations of both parties, it doesn't strip the owner of rights over their horse. The agreement sets the framework for a professional relationship, ensuring the welfare of the horse and clarity in expectations and responsibilities. In fact, it often includes provisions for visitation and encourages owner involvement.

Understanding these aspects of a Horse Training Contract can lead to more informed and satisfactory arrangements for both the owner and the trainer. Ensuring clarity and open communication from the outset lays the groundwork for a successful partnership that benefits the horse most of all.

Key takeaways

Filling out and using a Horse Training Contract is an essential step for horse owners seeking professional training services. Here are four key takeaways to consider:

  • Understanding of Terms: It's crucial for both the trainer and the horse owner to have a clear understanding of all terms outlined in the contract. This includes the fees, term, and location of the training, payment schedules, and any additional costs like veterinarian, farrier, and related services. Knowing these terms upfront can prevent misunderstandings and ensure a smooth professional relationship.
  • Payment Obligations and Procedures: The contract details the financial commitments required from the horse owner, including monthly training fees, pro-rating of fees at the beginning of the service, late fees, and provisions for lien enforcement by the trainer on the horse or equipment in case of non-payment. Owners should be diligent in meeting these payment obligations to avoid complications.
  • Risks and Responsibilities: Training a horse comes with inherent risks. The contract outlines the risks assumed by the horse owner, the standard of care provided by the trainer, and the owner's responsibility to obtain equine insurance for highly valued horses. Furthermore, it clarifies the liability and hold harmless clauses which protect the trainer from claims arising from the horse's behavior or any injuries on the premises, emphasizing the owner's acknowledgment and acceptance of these risks.
  • Contract Termination and Amendments: Conditions under which the contract may be terminated or amended are clearly stated. This includes provisions for early termination by the owner, the trainer's right to refuse a horse, and procedures for emergency care if the owner cannot be reached. Additionally, the agreement details the process for making changes to the contract, underscoring the importance of written communication for any modifications or termination notices.

Ensuring that both parties understand and agree to the details of the Horse Training Contract can help establish clear expectations and foster a positive and productive relationship between the trainer and the horse owner.
